2. Subject and Scope
This agreement sets out the procedures and principles regarding the distance sale and delivery of digital services, such as training programs and C2ISR platform subscriptions, offered by INTELEST and ordered by the buyer electronically through the website www.intelest.global.
3. Formation of the Agreement
By confirming this agreement and the preliminary information form electronically, the buyer declares that they accept the provisions of the agreement. The agreement enters into force at the moment the buyer confirms the order.
4. Product/Service Information
Training Programs: Details such as the name, content, duration, and dates of the training are specified separately in the order form.
C2ISR Platform: Details such as the subscription type, duration of use, and scope are specified separately in the order form.
The total price including taxes and payment details are presented to the buyer during the order process.
5. Payment and Access
Payment is completed at the time of order via methods such as credit card, bank transfer, etc.
The information required to use the digital products/services (e.g., username, password for training or platform access) is provided to the buyer via email or through the user panel after payment confirmation.
6. Right of Withdrawal
For Trainings:
For live (synchronous) trainings, the right of withdrawal can be exercised within 14 days without giving any reason, provided that the training has not yet started.
If the training has started and the performance of the service has begun (e.g., by joining the live session), the right of withdrawal cannot be exercised.
For the C2ISR Platform:
The performance of the service is deemed to have begun at the moment platform access is provided (i.e., when user credentials are shared via email or the panel).
Therefore, the right of withdrawal cannot be exercised for C2ISR platform subscriptions, as the performance of the service begins immediately with the buyer’s explicit prior consent, in accordance with applicable consumer protection laws regarding digital content (Turkish Law No. 6502, Art. 15/1-ğ).
7. Obligations of the Parties
Seller:
Is obligated to provide the training or platform access subject to the agreement as committed.
Is obligated to provide support within a reasonable time in case of technical access problems.
In cases where a refund is required, will make the refund within 14 days of receiving the withdrawal notification.
Buyer:
Is obligated to keep access information such as username and password confidential.
Cannot transfer, reproduce, or sell the training content or the platform to others.
Agrees that there is no right of withdrawal after the service has begun (e.g., after joining a live training or after platform access has been provided).
8. Liability and Force Majeure
Situations that develop beyond the control of the parties and prevent them from fulfilling the requirements of the agreement (e.g., natural disasters, technical failures, decisions by public authorities) are considered force majeure. In the event of force majeure, the parties shall not be held liable.
9. Applicable Law and Jurisdiction
This agreement is subject to the laws of the Republic of Turkey.
For transactions made by consumers, the Consumer Arbitration Committees and Consumer Courts have jurisdiction.
For commercial/corporate purchases, the Ankara Courts and Enforcement Offices have jurisdiction.
10. Entry into Force and Acceptance
This agreement enters into force on the date it is electronically confirmed. The parties declare that they have read, understood, and accepted all terms and conditions.
